Terms and Conditions for Sales at Legacy Exotics:

We reserve the right to modify, add, remove any portion of below terms.

· Payment:

o All payments for purchases are to be made in full before shipment.
o We accept PayPal / Square Pay/ Venmo/CashApp/ Bank Transfer (Zelle) payment. If using an option not available at checkout, please contact us.
o Payment plans are available for purchases with 25% down and the remaining balance paid within 30 days of hold date.
o Contact us for more information and to set up a payment plan for your purchase.
o Please note that any payments made toward the payment plan are non-refundable; any payments made is forfeited if cancelled and/or fail to comply with payment plan agreement.

· Shipping:

o Legacy Exotics offers free shipping exclusively within the USA for eligible orders.
o Shipping Monday through Wednesday, with arrival the following morning. We do not ship after Wednesday in case of shipping delay.
o Shipments will only occur if the temperature range from the destination to the hub to all shipping points falls between 45 degrees and 85 degrees Fahrenheit to ensure the safety and well-being of the geckos.
o We ship via FedEx overnight service, delivering either by a.m. or early p.m. to residents or to a FedEx Ship Center authorized to hold reptile shipments for pick-up.
o We reserve the right to not ship during holidays, events of extreme weather, FedEx issued alerts, due to volume delays at FedEx. We cannot guarantee if gecko(s) will arrive safely due to carrier delays.
o Please note, most shipments will be held for summer / winter holds at no additional cost.
o We will monitor situations closely if no delays are reported.

· Live Arrival Guarantee:

o We offer a live arrival guarantee for healthy animals.
o Dead-on-arrival (DOA) claims must be made within 30 minutes of the gecko's receipt.
o Carrier delays and/or loss of package is beyond our control are not the responsibility of Legacy Exotics.
o No credit or refunds will be given if carrier would lose a package or damage to package due to carrier error results in DOA.
o Replacements are only provided for qualifying dead-on-arrival cases and not for delays caused by the carrier.
o Purchaser must be 18 years or older and present to receive the animal.

Dead on Arrival (DOA):

o Buyers must provide pictures from all angles to identify the gecko(s) as being from Legacy Exotics in the event of a Dead on Arrival claim.

· Health Guarantee:

o All animals are guaranteed to be healthy at the time of shipping.
o However, bad husbandry, improper care, and diet by the buyer will disqualify any buyer for this guarantee.
o Buyers must report any health concerns within 24 to 48 hours from receipt for resolution.

Refunds and Replacements:

o Legacy Exotics does not offer refunds.
o Replacements will only be provided for qualifying dead-on-arrival guarantees reported within 30 minutes of receipt of the gecko.

· Legal Compliance:

o Buyers are responsible for ensuring that they comply with local, state, and federal laws regarding the ownership and importation of reptiles.
o Legacy Exotics is not liable for any legal issues arising from non-compliance.

· Communication:

o Clear and timely communication between buyers and Legacy Exotics is essential.
o Any inquiries, concerns, or issues should be addressed through our designated communication channels.

· Tail Loss:

o Tail loss in transit is not covered by our policy.
o We are not responsible for tail loss and I do not offer any refunds in the event of tail loss, once sale(s) has been made.
o Tail loss rarely occurs during shipping, but it can and does happen on occasion.
o Temporary stress during shipping may lead to tail loss, but it does not harm the gecko or affect its value.
o Tail loss is a natural defense mechanism in crested geckos and does not impact their overall well-being.
o This can occur prior to shipping or for any reason. Understand that this is a common occurrence with geckos and is often out of our control.

· Sex:

o I do not guarantee sex unless I clearly state that a gecko is male or female. Probable, possible, pores seen, or unseen, are not a 100% guarantee of sex. These are observations I offer to help you with your purchase as best I can.
o Animals sold as proven, have produced live offspring.
o Females sold as virgin have never been introduced to a male.

· Return Policy:

o All of the animals I ship are healthy and eating well to the best of my knowledge. I guarantee live arrival if the criteria for safe shipping are met.
o We do not offer refunds of any kind - all sales are final.
o We can help re-home the reptile if comes down to no longer able to care for the animal - but, would be at new owner's cost to ship reptile back to us.

If these conditions are not met, all guarantees are null and void.

o Before purchase of adoption - please be sure you agree with our terms and conditions. These are subject to change at any time and we expect you to be familiar with it prior to purchase.
